Terms & Conditions

Effective Date: December 20, 2021

These Terms & Conditions are entered into by and between ClickFuel Carrier Services, LLC ((“we”, “us”, “our”, “ClickFuel), having principal offices at 140 Huyshope Avenue, Hartford, CT 06106 and the Customer (“you”, “your”, “Customer”). By accessing or using the Services, you agree to be bound by these Terms and Conditions, which make up the Service Agreement between ClickFuel and Customer (the “Agreement”).

I. Definitions
  1. These Terms & Conditions are entered into by and between ClickFuel Carrier Services, LLC ((“we”, “us”, “our”, “ClickFuel), having principal offices at 140 Huyshope Avenue, a. “Affiliate” means with respect to Foley, each entity specifically named as an Affiliate herein, if any, so long as such entity controls, is controlled by, or is under common control with Foley. ClickFuel shall promptly notify Customer in writing of any additions or deletions to its list of Affiliates.
  2. b. “Authorized Contact” means named individuals designated by the Customer as having security authorization to contact ClickFuel to discuss testing programs and activity and/or seek assistance related to these Services.
  3. c. “Customer” means the legal entity specified on the Schedule, which shall include any subsidiary or division in which the Customer has a 50% ownership.
  4. d. “Schedule” means the document attached which outlines the program specific details.
  5. e. “Service Commencement Date” refers to the date of the order.
  6. f. “Point Product” means any product that is sold by ClickFuel to the Customer on an individual, non-renewing basis.
  7. g. “Protected Data” means any information specific to the Customer, which includes employee name, address, social security number, credit card number, etc.
  8. h. “Software” means any software utilized on the ClickFuel portal that was downloaded from any App store or distribution platform.
  9. CT 06106 and the Customer (“you”, “your”, “Customer”). By accessing or using the Services, you agree to be bound by these Terms and Conditions, which make up the Service Agreement between ClickFuel and Customer (the “Agreement”).
II. Our Services

ClickFuel is a provider of background screening services. In the United States, ClickFuel is defined as a “consumer reporting agency” pursuant to the applicable jurisdiction of the Fair Credit Reporting Act, 15 U.S.C. Section 1681 et seq. (“FCRA”) and applicable state law, and any FCRA-regulated screening reports that ClickFuel furnishes pursuant to this Agreement are defined by the FCRA and applicable state law as “consumer reports” and/or “investigative consumer reports.” All reports provided by ClickFuel pursuant to this Agreement are collectively defined as “Consumer Reports”, and all references to “Consumer Report(s)” herein shall refer to an entire Consumer Report(s) as well as any specific information contained within a Consumer Report(s). Subject to the terms and conditions of this Agreement, and upon End- User’s request, ClickFuel will furnish Consumer Reports for Employment Purposes and the related services described in this Agreement in connection with Customer’s screening, as applicable, of employees or candidates for employment (including, without limitation, independent contractors, temporary workers/employees, and volunteers), and/or other individuals for legally permissible employment-related purposes (each, an “Applicant”). End- User shall request Consumer Report for Employment Purposes pursuant to procedures prescribed by ClickFuel from time to time only when it is considering the individual inquired upon for employment, promotion, reassignment or retention as an employee, and for no other purpose. The FCRA imposes criminal penalties against anyone who knowingly and willfully obtains information on a consumer from a consumer reporting agency under false pretenses, including a fine, up to two years in prison, or both, pursuant to Section 1681q of the FCRA..

III. Support Services

So long as the Customer has not lapsed in the payment of the Fees, ClickFuel shall provide customer service to Customers via e-mail and phone to answer questions about our Services. Support is provided as long as a customer is covered under a Subscription Service. Normal customer service hours are 8:30 a.m. to 5:00 p.m. EST.

  1. a. E-mail Communication. The Customer agrees that all agreements, notices, disclosures and other communications will be provided to the Customer electronically and will satisfy any legal requirement that such communications be in writing. The Customer agrees to keep ClickFuel updated on any change to their preferred e-mail address.
  2. b. Wireless Phone Policy. By providing their wireless phone number to Foley, the Customer expressly gives ClickFuel consent to call them at this phone number – in person or through an automated system.
IV. Prices and Payment

Customer acknowledges that Customer has read, understands, and agrees to the “Payment Policy.”

V. License Grants and Restrictions

Unless otherwise expressly stated in the applicable Schedule, Foley`s fees in the Pricing provided to Customer correspond to Foley`s standard technology, product and service offerings, and exclude any customized technology development, training, reporting, product features and service levels. Should Customer request (and ClickFuel agree to provide) such customization, the parties shall set forth the corresponding terms and fees in a mutually acceptable written statement of work, addendum, or amendment.
